How we do it

If you or your family member believe that you can manage all or some aspect of your affairs, which is being managed by a Deputy, you will first require a mental capacity assessment to determine your capacity in the relevant matter.

Our teams of experts will be able to assess all the circumstances and provide a comprehensive report, which you can rely on in any proceedings to seek what is right for you or your family member. 

What happens next?

If you have the mental capacity

If you have the mental capacity to manage your affairs, we shall complete a COP3 that your Deputy must submit to Court of Protection to discharge himself or herself as a Deputy. This will allow you to take full and unhindered control of your financial affairs. If you do not trust that your Deputy will make the application to the Court, we shall recommend a firm of Solicitors that can support you to get yourself discharged from your Deputy.

If you do not have the mental capacity to manage your affairs but can make certain decisions about your affairs.

If you do not have the mental capacity to manage your property and financial affairs in full, we shall conduct assessments to check if you have the mental capacity to manage certain aspects of your affairs, which the Deputy is managing for you. If you have the mental capacity, we shall complete a report and engage your Deputy on your behalf to allow you the freedom to manage those aspects of your affairs.

For example, a client may not have the mental capacity to manage their property and financial affairs but may have the mental capacity to request for a change of Deputy, and or appoint another Deputy. Such a person can make an application to the Court to discharge the current Deputy, and appoint another one. You have every right to change your Deputy if you are not happy with them, and we shall support you to make the decision. 

If we do not get any success engaging your Solicitor, we shall recommend a firm of Solicitors that will be able to help you.

If you do not have the mental capacity to manage your affairs

If we conclude that you do not have the mental capacity to manage your affairs, we shall conduct a Best Interest Assessment to determine if your needs are being met by your Deputy in your best interest. We shall produce a report to highlight the outcome of the assessment and support you accordingly where necessary.

Our Staff are knowledgeable in this area and will be able to produce a watertight mental capacity and best interest assessment reports, which will meet the scrutiny of any Court in England and Wales.

Advocacy Services

Mental Capacity Consult will provide you with ongoing advocacy services where we shall be your mouthpiece if you feel unable to engage your Deputy to make the right decisions for you in your best interest.

Your Deputy is required by law to listen to you, allow you to make decisions for yourself, and only make decisions for you where you are unable to make such decisions. The decisions your Deputy makes must be in your best interest and must consider your views and that of your family in all circumstances.
